Mental Health Billing Codes in Practice

Mental Health Billing Codes in Practice

Psychotherapy and diagnostic codes look interchangeable on a fee schedule and behave nothing alike on a claim. One group is defined by minutes of face-to-face time, another by the work of an evaluation, and the add-on codes carry their own pairing rules. Choose from the wrong axis and a perfectly good note never gets read. This is the code set a behavioral health practice bills every day, what separates the codes, and the time rules that make the choice hard to argue with.

What this covers

  • 90791 and 90792 are untimed diagnostic evaluation codes. The medical version, 90792, needs a documented medical service, and neither code is billed incident to another practitioner or on the same day as an E/M service.
  • 90832, 90834 and 90837 are time ranges, not labels: 16 to 37 minutes, 38 to 52 minutes, and 53 minutes or more. Fewer than 16 minutes of psychotherapy is not billable.
  • 90833, 90836 and 90838 attach to an E/M service. The E/M is selected on medical decision making, and its minutes cannot be counted toward the psychotherapy.
  • 90785 interactive complexity and 90839/90840 crisis psychotherapy are different add-ons. Crisis codes stand alone, while 90785 pairs with diagnostic evaluations, individual psychotherapy and group psychotherapy.
  • 96127 bills per standardized instrument, and Medicare uses HCPCS code G0444 for the annual depression screening, so 96127 does not belong on that visit.
Time is the code. A 45-minute session written up without a start and stop time is a 45-minute session the payer cannot see.why time documentation, not the code alone, decides the claim

Behavioral health coding fails in a specific way. The clinical work is right, the note reads well, and the claim denies because the code was chosen on the wrong axis: the length of the visit instead of the service performed, or an add-on sitting on a primary code it was never allowed to touch. The rules that fix it are short, and they map the service to the code before anyone opens the chart to write.

The diagnostic evaluation codes come first, and neither is timed

The first decision in the chart is which evaluation code describes the visit. CPT code 90791 is a psychiatric diagnostic evaluation. CPT code 90792 is a psychiatric diagnostic evaluation with medical services. Both are untimed. Neither has a minute threshold, and neither is chosen from a range the way a therapy code is.

The medical piece separates them. A 90792 has to show exam elements tied to medical decision making, a medication prescribed or managed, or labs ordered and interpreted. If the note supports none of that, the encounter is a 90791.

CMS tells contractors that when a psychiatric diagnostic evaluation with medical assessment is performed, a physician or non-physician practitioner may report 90792 or an evaluation and management code. The choice sits between those two. Adding an E/M code on top of 90792 is not one of the options.

90792Psychiatric diagnostic evaluation with medical servicesUntimed

Noridian, a Medicare administrative contractor, adds the operational rules. Report the evaluation once per day. It can be reported more than once a year when a separate evaluation supports it. Do not bill it incident to another practitioner, and do not bill it on the same day as an E/M service by the same individual.

THE MEDICAL PIECE CARRIES 90792

A prescriber billing 90792 on prescribing authority alone invites a downcode. The note has to show the medical service that actually happened: the exam element, the medication decision, or the study ordered and interpreted.

Individual psychotherapy is defined by minutes

Individual psychotherapy codes are ranges. 90832 covers 16 to 37 minutes of face-to-face psychotherapy, 90834 covers 38 to 52 minutes, and 90837 covers 53 minutes or more. Pick the code closest to the actual time. Under 16 minutes, no psychotherapy code is billable at all.

CodeDescriptorMinutes
90832Psychotherapy, 30 minutes with patient16 to 37
90834Psychotherapy, 45 minutes with patient38 to 52
90837Psychotherapy, 60 minutes with patient53 or more
90833Psychotherapy, 30 minutes, with an E/M service16 to 37
90836Psychotherapy, 45 minutes, with an E/M service38 to 52
90838Psychotherapy, 60 minutes, with an E/M service53 or more

The time is face-to-face time with the patient. The record can carry start and stop times or a total, and the patient has to be present for all or some of the service. Time is the axis the payer audits, which is the discipline behind medical coding in this specialty.

The OIG’s national audit of psychotherapy claims shows what happens when time goes missing. For 128 of 216 sampled enrollee days the provider did not meet Medicare requirements, and the office estimated $580 million in improper payments out of the $1 billion that Medicare paid for psychotherapy. Psychotherapy time was not documented was the leading pattern.

The three add-ons, 90833, 90836 and 90838, attach only to an E/M service. The E/M is selected on medical decision making, the minutes spent on it do not count toward the psychotherapy, and the two services have to be separately identifiable in the record. That separation is what modifier 25 on the E/M line represents.

PROLONGED SERVICES STOP AT THE ADD-ONS

Medicare does not let a prolonged service code attach to the psychotherapy add-ons, and HCPCS code G2212 cannot be billed with 90837 or 90847. A 90837 reported without an E/M may take a prolonged service when the psychotherapy itself runs 90 minutes or longer in direct patient contact.

One volume limit applies. Psychotherapy codes are reported at one unit per date of service, except in a Medicare partial hospitalization setting, place of service 52, where a session can carry more than one unit.

Interactive complexity and crisis are two different add-ons

Two add-on codes capture extra intensity, and practices mix them up because both sound like a harder visit. They are not interchangeable.

Interactive complexity, 90785

90785 is an add-on for communication factors that complicate delivery of the primary service. It never stands alone. Four factors qualify, and at least one has to be present and documented during the visit.

  • Maladaptive communication among participants, such as high anxiety, high reactivity, repeated questions or disagreement that complicates care.
  • Caregiver emotions or behavior that interfere with carrying out the treatment plan.
  • Disclosure of a sentinel event and a mandated report to a third party, with the discussion that follows.
  • Use of play equipment, physical devices, an interpreter or a translator to overcome a communication barrier.

CMS pairs 90785 with the diagnostic evaluation codes 90791 and 90792, individual psychotherapy 90832, 90834 and 90837, the psychotherapy add-ons 90833, 90836 and 90838, and group psychotherapy 90853. It is excluded with family psychotherapy (90846, 90847, 90849), with the crisis codes, with an E/M service when no psychotherapy is reported, with the psychological and neuropsychological testing codes 96130 through 96139 and 96146, and with the adaptive behavior codes 97151 through 97158.

NAME THE FACTOR, NOT THE MOOD

A difficult or emotionally intense session is not interactive complexity. The note has to name the qualifying factor and say how it changed the delivery of care, such as an interpreter used throughout an evaluation or a caregiver who would not accept the plan.

Crisis psychotherapy, 90839 and 90840

90839 covers the first 60 minutes of psychotherapy for crisis, and 90840 covers each additional 30 minutes. These are standalone codes for a patient in high distress with a life-threatening, complex problem that needs immediate attention: an urgent assessment and history of the crisis state, a mental status exam, psychotherapy, work to defuse the crisis, and a disposition.

CMS lists the codes that cannot be reported with the crisis codes: 90791, 90792, the psychiatric services and procedures in the 90785 through 90899 range, and psychotherapy codes 90832 through 90838. In a non-facility place of service other than the office, report HCPCS codes G0017 and G0018 instead. Payment for crisis psychotherapy equals 150 percent of the non-facility fee schedule amount.

Family and group service codes run on their own rules

Family and group services use their own codes and their own practical rules. The patient-present question decides the family code, and the group roster decides the group code.

CodeDescriptorPatient present
90846Family psychotherapy (without the patient present)No
90847Family psychotherapy (conjoint psychotherapy) (with patient present)Yes
90849Multiple-family group psychotherapyMultiple families
90853Group psychotherapy (other than of a multiple-family group)Group members

Both family codes carry a 50-minute descriptor and focus on the patient’s treatment, not on history taking or general counseling. The record for a session without the patient still has to show the themes addressed, the interventions used, and how the family interaction bears on the plan.

Medicare treats multiple-family group psychotherapy 90849 more narrowly. Contractor guidelines describe it as generally non-covered, with claims considered on an individual basis.

Group psychotherapy 90853 is billed per attending member, each under that member’s own coverage, and each member’s record carries its own note. Documenting the length of the group session is recommended even though the code itself is not time-defined.

Screening and testing codes sit beside therapy, not inside it

Screening, formal testing, and therapy are three different services with three different code families. Mixing them is one of the more common self-inflicted denials in behavioral health.

96127 is a brief emotional or behavioral assessment with scoring and documentation, reported per standardized instrument. Two validated tools on one visit can support two units, and Medicare’s medically unlikely edit commonly caps the code at three units per date of service. The instrument has to be named in the record with its score and what the result changed.

Comprehensive testing splits across two roles. 96136 and 96137 cover test administration and scoring by a physician or other qualified health care professional, first 30 minutes and each additional 30 minutes. 96138 and 96139 cover the same work by a technician. The administration codes require two or more tests. The professional work that follows, including interpretation, report writing and feedback, bills under 96130 and 96131.

SCREENING IS NOT TESTING

A brief screener does not qualify as comprehensive testing, and a testing session is not a screening. Do not report 96127 on the same date as the testing codes, and confirm the payer’s unit rule before stacking instruments.

One Medicare substitution catches practices every year. The annual depression screening benefit for adults in primary care is billed with HCPCS code G0444, not 96127. Reserve 96127 for an instrument that assesses symptoms or tracks a condition already in the plan.

The documentation that makes the code hold

Every rule above lands in the same place: the note. Time sets the psychotherapy code and the record has to prove the time. Run this list before a claim leaves the practice.

  • Record face-to-face start and stop times, or total minutes, for 90832, 90834 and 90837, and for the psychotherapy portion of 90833, 90836 and 90838.
  • Keep E/M time and psychotherapy time separate so neither borrows from the other.
  • Show the medical service behind a 90792, and keep it off the same date as an E/M service.
  • Name the interactive complexity factor and describe how it changed the session when 90785 is billed.
  • Name the standardized instrument, its score, and the action the score triggered for 96127.
  • Sign the note. The OIG found missing signatures on 31 sampled enrollee days, a documentation failure even when the service was correct.
  • Refresh the treatment plan, generally every three months, with goals and progress toward them.

A practice that runs these checks has a short list of fixable problems. The alternative is the pattern this whole code set punishes: correct care, a defensible code, and a claim that fails on a missing time. The same documentation discipline carries the rest of the revenue cycle, which is where behavioral health revenue cycle management starts.

Mental health billing code questions

Is 90791 a time-based code?+

No. 90791 and 90792 are untimed diagnostic evaluation codes. What supports them is a complete evaluation, not a minute count. CMS requires start and stop times only for the psychotherapy codes 90832 through 90838. Report the evaluation once per day, and do not bill it on the same day as an E/M service by the same practitioner.

Can I bill 90837 and 90833 on the same day?+

No. 90837 is standalone psychotherapy, and 90833 is an add-on that only attaches to an E/M service. If a prescriber performs a medically necessary E/M and a separate psychotherapy service, the correct pair is the E/M code plus 90833, 90836 or 90838, with modifier 25 on the E/M and the two services documented as separately identifiable.

When does the interactive complexity add-on 90785 apply?+

When at least one of four communication factors is present and documented during the visit: maladaptive communication among participants, caregiver behavior that interferes with the treatment plan, a sentinel event with a mandated report, or use of play equipment, devices, an interpreter or a translator. The note must name the factor and explain how it changed delivery of the primary service.

Can crisis psychotherapy be billed with a regular psychotherapy code?+

No. Codes 90839 and 90840 are standalone and cannot be reported with 90791, 90792, the psychiatric services in the 90785 through 90899 range, or psychotherapy codes 90832 through 90838. 90840 is an add-on only to 90839, covering each additional 30 minutes beyond the first 60 minutes of crisis psychotherapy.

Does group psychotherapy 90853 require documented time?+

The code is not time-defined, so no minute range drives it. Documenting the session length is still recommended, and each attending member needs a note in that member’s own record. Bill 90853 once per attending member per session, never for a member who was not present, and confirm the payer’s participant limit.

Is 96127 the right code for a Medicare annual depression screening?+

No. Medicare’s annual depression screening benefit for adults in primary care is billed with HCPCS code G0444. Code 96127 is a brief emotional or behavioral assessment reported per standardized instrument when the tool assesses symptoms or tracks a documented condition. Using 96127 for the routine annual screen is a common denial.

The bottom line

The codes are not hard to learn. They are easy to assign from the wrong axis. Take the code from the service performed and the documented time, then make the note carry both. A practice that does that stops explaining denials and starts defending claims.
